TERMS OF SERVICE

Welcome to Apex Mark & Seal ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website www.apexmarkseal.com (the "Site") and the mobile notary, loan signing, trust and estate signing, apostille facilitation, and fingerprinting services we provide (collectively, the "Services"). By scheduling an appointment or using our Services, you agree to be bound by these Terms.

 

1. Description of Services

Apex Mark & Seal is a mobile service provider operating in South Jersey. We travel to client-specified locations to perform notary public duties, loan signings, trust executions, fingerprinting, and apostille logistics. We are not attorneys and do not provide legal advice, draft legal documents, or advise on the legal effects of any documents.

 

2. Client Responsibilities

To successfully complete our Services, you agree to ensure that:

  • Identification: Every signer must present a valid, unexpired, government-issued photo identification (e.g., Driver's License or Passport) at the time of service.

  • Preparedness: Documents must be complete with no missing pages or blank spaces prior to the notary's arrival. Signers must not sign or date documents until instructed by the notary.

  • Competency and Willingness: All signers must be physically present, mentally alert, and capable of understanding and voluntarily signing the documents.

  • Fingerprinting: For ink fingerprinting, you are responsible for providing the exact card type or paperwork required by your requesting agency or employer.

 

3. Appointments, Travel, and Cancellations

  • Travel Fees: A non-refundable travel/service fee is required to secure mobile appointments. This fee covers our time and transit to your location.

  • Cancellations: Cancellations must be made at least [e.g., 2 hours] prior to the scheduled appointment time.

  • Unfulfillable Appointments: If an appointment cannot be completed upon our arrival due to invalid ID, missing signers, incomplete documents, or a signer's lack of capacity/willingness, the travel fee remains fully due and non-refundable.

 

4. Fees and Payment

  • All fees for Services rendered are due at or before the time of service unless prior corporate billing terms have been established.

  • We accept [list payment methods, e.g., credit cards, cash, Venmo].

  • Notary stamp fees are dictated by New Jersey state law, while travel, after-hours, and specialized convenience fees are determined by the Company and agreed upon during booking.

 

5. Limitation of Liability

To the maximum extent permitted by New Jersey law, Apex Mark & Seal and its agents shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of or in connection with the Services provided. Our total liability for any claim shall not exceed the total amount paid by you for the specific service in question. We are not responsible for deadlines missed due to courier delays (for apostilles), client paperwork errors, or third-party rejection of legally notarized documents.

 

6. Governing Law

These Terms and any disputes arising out of your relationship with Apex Mark & Seal shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.
